These Terms & Conditions "Terms" govern your use of www.dominiquelondon.be (“the Website”) and any purchases you make from Dominique London NV (“Dominique London”, “we”, “us”, “our”). By accessing the Website or placing an order, you agree to be bound by these Terms.

2. ELIGIBILITY AND AGE VERIFICATION

1.1 We do not market or sell tobacco products to anyone under 18 years of age (or the higher minimum age in your jurisdiction).

2.2 By using the Website or placing an order, you confirm that you are of legal age where you reside and consent to reasonable age-verification checks.

1.3 If you are not of legal age, you must not use the Website or purchase products.

3. HEALTH INFORMATION

3.1 Tobacco use is harmful to health.

3.2 You acknowledge that tobacco use is at your own risk. To the fullest extent permitted by law, we are not liable for any health effects arising from tobacco use.

4. PRODUCTS, INFORMATION AND CONTRACT FORMATION

4.1 Product descriptions, photographs and specifications are provided for general information and may not always reflect the most recent presentation.

4.2 All products and prices displayed on the Website constitute an invitation to treat, not a binding offer.

4.3 All products are offered subject to availability.

4.4 After checkout, you will receive an automated acknowledgement. This is not an order confirmation.

4.5 A contract is formed only when we:

  • verify product availability, and
  • send an order confirmation or dispatch notice.

4.6 We reserve the right to refuse or cancel an order if:

  • a product is unavailable,
  • there is an error in pricing or description,
  • fraudulent activity is suspected, or
  • the order otherwise breaches these Terms.

5. PRICES, CURRENCY AND TAXES

5.1 Prices are listed in Euros (€) and exclude delivery charges unless stated.

5.2 If a pricing error is discovered, we may cancel the order and refund any payment made.

5.3 If you pay from a non-Euro account, your payment provider may apply currency conversion fees.

6. PAYMENT AND AUTHORISATION

5.1 By submitting an order, you confirm that:

  • all payment information is accurate;
  • you are authorised to use the payment method;
  • you agree to pay all charges incurred.

6.2 We may request additional verification to prevent fraud.

6.3 Your payment method may be charged upon order submission.

6.4 Payments are processed securely by third-party providers (including Viva Wallet). We do not store full card numbers.

7. SHIPPING, DELIVERY TIMES AND RISK

7.1 Products are normally shipped in original manufacturer packaging.

7.2 We usually ship via Bpost. Estimated (non-guaranteed) transit times:

  • Belgium: 2–4 business days
  • Rest of world: 15–20 business days

7.3 Delivery times may vary due to postal and customs delays.

7.4 Risk passes to you upon delivery or first attempted delivery.

8. CUSTOMS, DUTIES AND IMPORT COMPLIANCE

8.1 You are responsible for complying with local import laws.

8.2 All customs duties, taxes, handling fees and delays are your responsibility.

8.3 You confirm that you understand your local import rules before ordering.

9. DELIVERY GUARANTEE AND EXCEPTIONS

9.1 If a shipment is confirmed lost by the carrier, we will reship or refund the order.

8.2 Delivery guarantee does not apply if non-delivery results from:

  • incorrect or incomplete address;
  • failure to update address details
  • repeated unsuccessful delivery attempts
  • tracking showing “delivered”;
  • customs refusal or import restrictions;
  • any issue within your control.

9.3 If goods are returned to us in good condition, refunds may be issued subject to a 10% administrative fee, plus any shipping costs.

10. UNDELIVERED ORDERS — NOTIFICATION PERIOD

Claims of non-delivery must be submitted within 30 days of dispatch.

After this period we cannot file a carrier claim and accept no responsibility for non-delivery.

11. CANCELLATIONS, RETURNS AND RESTOCKING

11.1 You may return unused items in original packaging within 14 days of receipt.

11.2 Approved returns are subject to a 10% administrative fee, plus shipping costs, unless goods are faulty or misdescribed.

11.3 Return shipping is your responsibility unless goods are faulty or substitutes were supplied.

11.4 The cancellation policy does not apply if:

  • damage results from misuse, negligence or improper storage;
  • goods were altered or opened;
  • packaging was intentionally removed or damaged;
  • goods were used contrary to manufacturer instructions.

11.5 Your statutory rights remain unaffected.

11.6 Returns should be sent to our Belgian address unless instructed otherwise.

12. PRODUCT IMAGERY AND VARIATIONS

12.1 Packaging may change over time.

12.2 Minor variations or image differences do not constitute misdescription where the correct product line and quantity are supplied.

13. WEBSITE USE (PERMITTED & PROHIBITED)

13.1 You may use Website material for personal, non-commercial purposes only.

13.2 You may not:

  • create a database or archive using Website content;
  • redistribute Website material without permission;
  • remove copyright notices;
  • upload or transmit harmful, offensive or unlawful material;
  • attempt to disrupt the Website via malware or code injection.

13.3 Downloads and use of the Website are at your own risk.

13.4 We do not guarantee uninterrupted or error-free operation.

14. ENTIRE AGREEMENT AND CHANGES

These Terms, together with our Privacy & Data Security Policy and Cookie Policy, form the entire agreement.

We may update these Terms at any time by posting the revised version on the Website.

15. LIMITATION OF LIABILITY

15.1 Our total liability for any order is limited to the amount you paid, including original delivery charges where applicable.

15.2 We are not liable for indirect or consequential loss (including loss of profit, goodwill or data).

15.3 Nothing excludes liability where it would be unlawful to do so.

16. COMPLAINTS

16.1 Contact us at info@dominiquelondon.com with your order number and details.

16.2 We aim to acknowledge complaints within 3 business days and resolve them within 7.

17. GOVERNING LAW AND JURISDICTION

These Terms are governed by Belgian law.

Disputes shall be subject to the exclusive jurisdiction of the Belgian courts, without prejudice to consumer protection rights in your country of residence.
